These Terms of Website Use (“Terms”) govern access to and use of https://greyskygraphics-socialmedia-services.com/ and its content, account, shop, forms, and related features (the “Website”), operated by Grey Sky Graphics Studio LLC (“GSG,” “Grey Sky Graphics,” “Studio,” “we,” “us,” or “our”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website. Purchases and services are also governed by the Service Agreement, applicable Order, Privacy Policy, Refund Policy, and Cookie Policy.

1. Eligibility and authority

You must be at least 18 years old and legally capable of entering a contract. If you use the Website for a company or other organization, you represent that you have authority to bind it, and “you” includes that organization.

2. Permitted use

GSG grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for lawful personal or internal business purposes. You may not:

• Copy, reproduce, republish, sell, license, scrape, frame, mirror, or commercially exploit Website content except with written permission or as allowed by law.
• Use automated systems to extract data, train models, benchmark, monitor, or access the Website in a manner that burdens or bypasses technical controls.
• Attempt to gain unauthorized access, test vulnerabilities without permission, introduce malware, disrupt operation, or interfere with another user.
• Impersonate another person, submit false information, misuse forms or accounts, or engage in fraud, spam, harassment, unlawful discrimination, or illegal activity.
• Infringe intellectual property, privacy, publicity, confidentiality, or other rights, or upload unlawful, deceptive, defamatory, or harmful material.
• Circumvent access, geographic, checkout, pricing, account, or security restrictions.

3. Accounts and security

You are responsible for information submitted through your account and for keeping credentials confidential. Notify GSG promptly of suspected unauthorized use. We may suspend or close accounts that violate these Terms, create security risk, remain unpaid, or are inactive, subject to applicable law and contractual obligations.

4. Website content and intellectual property

The Website and its text, graphics, photographs, video, branding, layout, code, templates, and other content are owned by or licensed to GSG and protected by intellectual-property laws. “Grey Sky Graphics,” associated logos, and trade dress may not be used without written permission. No right is granted except the limited access right expressly stated in these Terms.

Portfolio work may belong to GSG, a client, or a licensor. Display on the Website does not grant permission to copy, adapt, distribute, or use it. If you believe content infringes your rights, send a detailed notice to info@greyskygraphics.com.

5. User submissions and feedback

You retain ownership of material you submit. You grant GSG a nonexclusive, worldwide, royalty-free license to host, copy, transmit, modify, and use it as necessary to operate the Website, respond to you, and provide requested services. You represent that you have the necessary rights and that your submission is accurate and lawful. Feedback and suggestions may be used without restriction or compensation, provided GSG does not publicly identify you without permission.

6. Information, pricing, and availability

Website information is provided for general information and may contain typographical errors, outdated examples, or incomplete descriptions. GSG may correct errors and update or discontinue content, services, features, availability, and prospective pricing. “Starting at” prices are not binding quotes. A purchase is accepted only when GSG confirms the Order or begins performance. If a material pricing or description error affects an Order, GSG may cancel it and refund the affected amount or offer corrected terms.

7. Third-party websites and services

Links, embeds, plugins, payment tools, social networks, and other third-party features are provided for convenience. GSG does not control or endorse them and is not responsible for their content, availability, security, accessibility, terms, or privacy practices. Your use is governed by the third party’s terms.

8. Disclaimer

The Website is provided “as is” and “as available.” To the maximum extent permitted by law, GSG disclaims all express and implied warranties, including accuracy, availability, security, merchantability, fitness for a particular purpose, title, and non-infringement. GSG does not warrant that the Website will be uninterrupted, error-free, or free of harmful components. Website content is not legal, tax, financial, medical, or other professional advice.

9. Limitation of liability

To the maximum extent permitted by law, GSG will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost data, profits, revenue, goodwill, or opportunity, arising from Website use. GSG’s total liability for a Website-only claim will not exceed the greater of US$100 or the amount you paid GSG for Website access during the six months before the claim. These limits do not apply where prohibited by law.

10. Indemnification

You will defend, indemnify, and hold harmless GSG and its personnel from third-party claims, losses, penalties, costs, and reasonable legal fees arising from your submissions, misuse of the Website, violation of law or third-party rights, or breach of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Before filing a claim, the parties will attempt in good faith for thirty days to resolve it through written notice. Any dispute arising from these Terms or use of the Website will be handled exclusively in the state or federal courts located in Orange County, California, unless the parties agree in writing to another dispute-resolution process. Each party consents to the personal jurisdiction and venue of those courts. Mandatory consumer rights are not waived.

12. Changes, suspension, and general terms

GSG may update these Terms prospectively by posting a revised version and effective date. Continued use after the effective date constitutes acceptance where permitted by law. GSG may suspend or discontinue the Website. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder remains effective. Failure to enforce a provision is not a waiver. These Terms, together with policies incorporated by reference, are the complete agreement regarding Website use.
